1) Eligibility:

3) How to Participate:
- Receive one (1) entry (“Entry”) when you make a single purchase of a pink virtual gift or a pink virtual sticker pack or any pink nick name during the Sweepstakes Entry Period. Limit 10 entries per day. Here are the following eleven (11) Virtual Gifts, Stickers or Nicks:

Sweepstakes: The “Shop Pink and Win” Sweepstakes (“Sweepstakes”) is sponsored by AVM Software, Inc., PO Box 326 Jericho, NY 11753 (“Sponsor”). The Sweepstakes starts at 12:00:01 AM Eastern Daylight Time (EDT) on the 13th of October, 2014 (05:00:01 on the 13th of October BST) and ends at 11:59:59 EDT on the 31st of October 2014 (03:59:59 on the 1st of November GMT) (“Sweepstakes Entry Period”). All applicable United States, United Kingdom, Canadian National, Provincial and local rules apply. Void where prohibited.
Eligibility: You must be a legal resident of the 50 United States or the District of Columbia, Canada (excluding Quebec) or the United Kingdom, age 18 or older. Employees of AVM Software, Inc. and its advertising agencies, or persons involved in any part of the administration and execution of this Sweepstakes (“Sweepstakes Entities”) and immediate family members (spouses, domestic partners and parents, children and siblings regardless of where they live) of any such employees are not eligible to enter. Sponsor’s designated computer is the official time keeping device for all aspects of the Sweepstakes.
How to Enter: There are two methods of entry:
Method 1: You will automatically receive one (1) entry (“Entry”) when you make a single purchase of a pink virtual gift (Inclusive of pink heart, pink hat, pink purse, pink diamond, pink shoes, pink sunglasses, pink earrings) or a pink virtual sticker pack or any pink nick name during the Sweepstakes Entry Period.
Method 2: To enter without making a purchase send an email to shoppinkandwin@paltalk.com and provide your email address, name, postal address and phone number where you can be contacted during the Sweepstakes Entry Period (“Entry”).
Limit ten (10) Entries per Day regardless of method of entry. The person submitting an Entry(ies) will be deemed the “Entrant.” A Day commences on 12:00:01 AM EDT and ends at 11:59:59 EDT each calendar day during the Sweepstakes Entry Period. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant’s Entries and that Entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. All Entries become the property of Sponsor and will not be returned or acknowledged
Selection of Winner: One (1) potential prize winner will be selected in a random drawing held by a representative of Sponsor on the 4th of November 2014 at 2 PM EDT at 1 Penn Plaza, New York, New York. from among all eligible Entries received. Odds of being selected as a potential winner depends on the number of eligible Entries received during the Sweepstakes Entry Period.
Canadian Residents: If the selected winner is a resident of Canada, s/he will have to correctly answer an unaided, mathematical skill-testing question (“Skill Question”) in order to be declared the winner.
Notification of Winner: The potential winner will be notified via the email provided upon submission or in the member’s account. The potential winner must respond within five (5) days of its being sent to provide a postal address for delivery of the prize (and if a Canadian resident must correctly answer the Skill Question) in order to be declared the winner. If a potential prize winner does not respond to the winner notification message (message will be sent three (3) times over a five (5) day period), or, if a Canadian resident, fails to correctly answer the Skill Question within the time specified, or if an Entrant is otherwise found to be ineligible, does not provide required information, or if the selected winner cannot accept or receive the prize for any reason, the potential prize winner will forfeit the prize and an alternate winner may, in the sole discretion of the Sponsor, be selected from among the remaining eligible Entries. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any. Acceptance of prize constitutes permission (except where prohibited by law) to use each winner’s name, prize won, hometown and likeness for promotional purposes relating to this Sweepstakes without further compensation. Sponsor reserves the right to require evidence to verify eligibility.
Prize: One (1) prize will be awarded of an iPhone 6 64GB Silver (approximate retail value = $299.00 USD). The Prize is non-transferable and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. Winner is responsible for all federal, provincial, local, provincial taxes, duties and fees, if any or other expenses relating to the use, acceptance and possession of prize.
General: Sponsor reserves the right, in its sole discretion, at any time and at any stage to reject or disqualify any Entry that is deemed ineligible or for any reason that the Sponsor feels is necessary and/or appropriate, including without limitation, if that Entrant has not complied with these Official Rules or has interfered, in Sponsor’s sole opinion, with the proper conduct of the Sweepstakes. By submitting an Entry, you agree to release the Sweepstakes Entities, the judges and any entity or person involved in the Sweepstakes or fulfillment of the prize and each of their respective officers, directors, agents, representatives and employees, and each of these companies and individuals’ respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in the Sweepstakes, including the awarding, use or misuse of any prize. The Released Parties shall not be liable for: (1) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, garbled Entries; (2) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (3) data corruption, theft, destruction, unauthorized access to or alteration of an Entry; (4) any injuries, losses or damages of any kind caused by participation in the Sweepstakes or use or misuse of the prize; or (5) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. The Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes corrupt the administration, security, fairness or proper play of the Sweepstakes. The Sponsor may disqualify any Entrant if, in its sole discretion, it determines s/he is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or the Sponsor, the judges or their respective representatives. In the event of a dispute regarding the identity of an Entrant, said dispute will be resolved in favor of the individual who is the “authorized e-mail account holder” of the Entry. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.The Sponsor shall not be responsible if the Sweepstakes does not take place for any reason including delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism, including without limitation, or for any reason outside of the Sponsor’s control.
Governing Law/Disputes: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant, Sponsor or the Released Parties in connection with the Sweepstakes must be brought in a court of competent jurisdiction within the United States in New York County, New York and the terms, or any dispute, will be governed by the laws of the State of New York. Any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, shall be resolved individually, without resort to any form of class action.
ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
Privacy: Sponsor will be collecting personal data about Entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy posted on http://www.paltalk.com/privacy.shtml. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of Entrant’s personal information in accordance with the Sponsor’s privacy policy and acknowledges that Entrant has read and accepted Sponsor’s privacy policy.
Prize Winners: For the names of the winner (available after 11/30/14), mail a self-addressed, stamped envelope to Shop Pink To Win Sweepstakes, Winners’ List or Rules, AVM Software, PO Box 326 Jericho, NY 11753 or send an email shoppinkandwin@paltalk.com no later than 1/30/15.
